In Re:- An application for bail under Section 439 of the Code of
Criminal Procedure filed on 07.01.2019 in connection with
Bhagwangola P.S. Case No.541 of 2018 dated 18.11.2018 under
Sections 498A/302 of the Indian Penal Code.

Heard the learned Counsels appearing on behalf of the parties.

It is submitted on behalf of the petitioners that they are the

married sisters-in-law of the victim housewife and it is also

submitted that they did not play any role in the matrimonial life of

the victim.

Learned Advocate appearing for the State opposes the prayer

for bail.

Having considered the materials in the Case Diary and bearing

in mind the extent of complicity of the petitioners in the alleged

crime and in view of the oral dying declaration made by the victim

housewife to the medical officer at page 44 of the Case Diary which

does not implicate them, we are inclined to grant bail to the


Accordingly, the petitioners, namely, Anjali Mondal, Radha

Mondal and Tanu Mondal @ Kakoli Mondal shall be released on bail

upon furnishing a bond of Rs.10,000/- each with two sureties of like

amount each, one of whom must be local, to the satisfaction of the

learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad

subject to condition that the petitioners shall appear before the trial

court on every date of hearing until further orders and shall not

intimidate witnesses or tamper with evidence in any manner


In the event the petitioners fail to appear before the Trial Court

without any justifiable cause, the trial Court shall be at liberty to

cancel their bail in accordance with law without further reference to

this Court.

The application, being C.R.M.309 of 2019, is disposed of.
