The petitioners seek quashing of FIR No.572 dated

31.12.2012, under Sections 406/498A IPC registered at Police Station Mani

Majra, District Chandigarh, on the basis of compromise (Annexure P-2)

having been effected amongst the parties.

Vide order dated 1.3.2018, the parties were directed to appear

before the Illaqa Magistrate to get their statements recorded in respect of

alleged compromise. Report of JMIC, Chandigarh has been received.

The learned JMIC, Chandigarh has recorded the statement of

the complainant Ms. Pooja Sood Beri, who has stated that she has received

a part payment of ` 2 lacs from the accused, in view of the compromise

effected in the Lok Adalat on 25.9.2017 and that she has no objection in

case the FIR in question is quashed against all the accused. She has further

stated therein that she is willing to receive part payment of ` 5 lacs at the

time of recording the final statement in the proceedings pertaining to grant

of divorce by mutual consent under Section 13-B of the Hindu Marriage

Act, 1955. It has been informed by learned proxy counsel for Mr.

Shalender Mohan, Advocate that in fact the marriage between the parties

has already been dissolved by divorce by mutual consent.

In view of the above stated position, I am satisfied that the

matter has been amicably resolved. Accordingly the petition is accepted

and the FIR and all consequent proceedings are hereby quashed.
