AO/319/2019 on 2 November, 2019

AO No. 319 of 2019
Hon’ble Alok Singh, J.

Hon’ble Ravindra Maithani, J.

Hon’ble Alok Singh, J (Oral)
Mr. Neeraj Garg, Advocate for the
appellant.

Mr. B.M. Pingal, Advocate, holding brief
of Mr. D.C.S. Rawat, Advocate, for the
respondent.

The instant appeal is preferred against
the order dated 13.06.2019 passed by Addl.
Judge, Family Court, Dehradun in Original Suit
No. 1080 of 2017 (Smt. Rashmi Chauhan Rana
Vs. Sohan Singh Rana). By the impugned
order, application filed by respondent under
Section 24 of the Hindu Marriage Act, 1955 has
been allowed and the appellant has been
directed to pay Rs. 20,000/- as expenses of
litigation and Rs. 15,000/- per month, as
maintenance pendente lite.

During the course of argument, learned
counsel for both the parties are agreeable that
amount of maintenance pendente lite may be
fixed as Rs. 10,000/- per month.

Having considered the matter, the
amount as awarded against expenses of
litigation as Rs. 20,000/- is confirmed.
Impugned order is upheld to that extent.

Insofar as maintenance pendente lite is
concerned, it is fixed as Rs. 10,000/- per month
on the basis of consensus between the parties.
Impugned order gets modified to that extent
only.

Appeal is disposed of in terms of orders,
as above.
