3 16-12-2019 Issue notice to opposite party no. 2 by both modes,

ordinary process as well as registered cover with A/D, for which

requisites etc. must be filed till 8 th of January, 2020, failing

which this application shall stand dismissed without further

reference to the Bench.

In the nature of the submissions made on behalf of the

petitioner saying that the petitioner and daughter of opposite

party no. 2 were at one point of time known to each other and

they had developed friendship but later on they had fallen apart

and due to some misunderstanding which cropped up before
Patna High Court CR. MISC. No.76438 of 2019(3) dt.16-12-2019

marriage, the marriage could not be arranged with the daughter

of opposite party no. 2 and for that reason alone this case has

been lodged at Bhagalpur on certain allegations which do not

constitute any offence under Section 406 I.P.C. or under Section

4 of the Dowry Prohibition Act, there will be a stay of further

proceeding in the court below.

Let the matter be listed on 3rd February, 2020.
