This is an application under Section 482 read with
Section 407 of the Code of Criminal Procedure filed by the
petitioner/accused praying for quashing of the proceedings
being G.R. Case No. 1066 of 2019 arising out of Daspur Police
Station Case No. 419 of 2019 dated 19th October, 2019 under
Sections 498A/323/307/406/34 of the Indian Penal Code
read with Section 3/ 4 of the Dowry Prohibition Act.
Learned counsel appearing for the petitioner submits
that the opposite party no. 2/wife had filed two complaints
before two different Police Stations of two different Districts in
respect of the self-same allegation. According to his
contention, the present proceedings have been initiated on the
basis of the second complaint lodged by the opposite
Having regard to the submission made by learned
counsel appearing for the petitioner, the petitioner is directed
to serve the copies of the present application along with all
documents to the opposite party no. 1/the State of West
Bengal through the office of the learned Public Prosecutor and
to the opposite party no. 2 by speed post with
acknowledgement due within one week from date and to file
affidavit-of-service within two weeks thereafter.
Let the matter appear in the list under the same
heading “Listed Motion” two weeks hence.
The petitioner is given liberty to pray for stay upon
service of notice to the opposite parties.
Urgent photostat certified copies of this order, if applied
for, be given to the parties upon compliance of all necessary
