RAJ SHEKHAR ATTRI, J. (Oral)
The petitioner has preferred the instant petition under Section
438 Cr.P.C., for grant of pre-arrest bail in case FIR No.80 dated
20.06.2018, registered under Sections 406, 498-A, 377, 506/34 IPC
(Section 377 IPC has been deleted) at Police Station Women, Rohtak.
Learned counsel for the parties have submitted that the matter
has been settled between the parties and petition under Section 13-B of the
Hindu Marriage Act has already been filed.
In this view of the matter, without going into the merits of the
case, I do not deem it appropriate to deny the concession of anticipatory
bail to the petitioner in the present case.
Resultantly, the interim order dated 04.09.2018 is made
absolute subject to the conditions as envisaged under Section 438(2)
Cr.P.C.
Petition stands allowed.
