In Re: – An application for anticipatory bail under Section 438 of the
Code of Criminal Procedure filed on 20.04.2020 in connection with
Pandua P.S. Case No. 39 of 2020 dated 26.01.2020 under
Sections 498A/406/307/354 of the Indian Penal Code.

Petitioners undertake to affirm and stamp the

petition/application as per Rules within 48 hours of resumption of

normal functioning of the Court. Subject to such undertaking, the

application is taken up for hearing through video conference.

It is submitted on behalf of the petitioners that the marriage

occurred in 2003 and they have been falsely implicated in the

instant case. Allegation of attempt to murder the victim housewife is

patently absurd and inherently improbable.

Case diary be produced before this court on the next date of

hearing.

Let this matter appear for further hearing two months hence.

Keeping in mind the facts and circumstances of the case, we

direct that the petitioners namely, (1) Arup Ghosh (2) Sonatan

Ghosh (3) Menoka Ghosh (4) Basudeb Ghosh (5) Utpala Ghosh (6)

Prabhat Ghosh (7) Tanmoy Ghosh (8) Ambika Ghosh shall not be

arrested in connection with this case for a period of three months or

until further orders, whichever is earlier on condition that the

petitioners shall cooperate with the investigation in accordance with

law and shall not intimidate witnesses or tamper with evidence in

any manner whatsoever and on further condition that they shall

reside in their respective residences and shall not leave the

residence without the permission of the officer-in-charge of the

police station within whose jurisdiction they shall presently reside.

The application being CRAN 1646 of 2020 is accordingly,

disposed of.

The parties shall act in terms of the copy of the order

downloaded from the official website of this court.
