1. Petitioner has preferred this Criminal Miscellaneous Petition

seeking quashing of FIR No.9/2016 registered at Police Station

Mahila Thana, Jaipur (South).

2. It is contended by counsel for the petitioner that parties have

amicably settled their dispute. They have moved an application

under Section 13-B of the Hindu Marriage Act and have obtained

divorce by mutual consent. A compromise deed was filed before

the Court below. Court has compounded the offence under Section

406 IPC but as remaining offences were non-compoundable, the

same were not compounded.

3. Complainant along with her counsel is present in the Court,

who has not disputed the fact of parties having entered into

compromise. She does not wish to proceed further in the FIR

lodged by her.

4. I have considered the contentions.

5. In view of the fact that parties have amicably settled the

dispute, the present Criminal Miscellaneous Petition is allowed and

proceedings pending before learned Metropolitan Magistrate No.1,

Jaipur Metropolitan in Criminal Case No. 223/2018 in relation to

FIR No.9/2016 stand quashed.
