1. This is an application for permission of this Court for
issuance of passport to the applicant. The applicant is convicted of
the offence punishable under Section 498A of the Indian Penal
Code and is sentenced to suffer rigorous imprisonment for three

years apart from payment of fine of Rs.1 Lac and in default to
undergo rigorous imprisonment for one year.
2. The appeal challenging conviction and resultant sentence
imposed on the applicant is pending before this Court. The
applicant seeks permission of this Court to apply for re-issuance of
the passport by stating that his earlier passport is lost and the
report of that fact is already filed by him.
3. Heard the learned Counsel for the applicant as well as the
learned Counsel for respondent Nos.2 and 3. None appeared for
the Regional Passport Officer. The learned APP appears for the
State.
4. The applicant is permitted to apply for re-issuance of
passport in his favour. However, the terms and conditions as well
as period for validity of the passport shall be at the discretion of
the Passport Authority.
5. With this order, the application is disposed of.
