The contention of the petitioner is that maintenance

pendente lite awarded in divorce petition filed by him to the tune of

`5000/- per month is on the higher side, as the respondent-wife is

living in the same house and he has to look after two children. The

respondent-wife is engaged in stitching and milk vending work and

earning more than `15,000/- per month.

I am afraid aforementioned argument would not be

sustainable, as no proof of such income has been placed on record.

There is no bar for the wife to claim maintenance even if she is

sharing the same roof with the husband. This is minimum amount of

maintenance pendente lite by assessing the income of the petitioner as

`35,000/- to `40,000/- per month

I do not find any illegality and infirmity in the order

under challenge. No ground for interference is made out. Resultantly,

the revision petition is dismissed.
