Asif Ali Khan vs The State Of Madhya Pradesh on 23 April, 2018

Criminal Appeal No.2724/2018
Jabalpur Dated : 23.4.2018
Mr.Rajesh Patel, learned counsel for the appellant.
Mr.D.K.Paroha, learned Government Advocate for the

Heard on I.A.No.5385/2018, an application for grant
of bail on behalf of appellant.

The appellant has been convicted for offences under
sections 354 IPC and sentenced to RI for three years and a
fine of Rs.2000/- and in default of payment of fine
additional RI for one month, under section 457 IPC and
sentenced to RI for two years and a fine of Rs.3000/- and in
default of payment of fine additional RI for one month and
under section 323 IPC, sentenced to a fine of Rs.500/-. He
has also been convicted under section 8 of the Protection of
Children from Sexual Offences Act and sentenced to RI for
three years and a fine of Rs.2,000/-, in default of payment
of fine RI for six months.

Looking to the short sentence of three years, I am
inclined to allow I.A.No.5385/2018 and suspend the
remaining part of the sentence imposed upon the appellant
and direct that the appellant be released on bail on his
furnishing a personal bond in the sum of Rs.50,000/-
(Rupees Fifty Thousand only) with one surety in the like
amount to the satisfaction of the Trial Court.

Call for the record of the Trial Court. List immediately
thereafter for orders on admission.

Certified copy as per rules.
