In the matter of: – Asto Barik

Mr. Niladri Sekhar Ghosh
…for the petitioner.

Ms. Faria Hossain

The petitioners are seeking bail in connection with a case relating

to offence punishable under Sections 498A/406/494/504/506(2)/34 of

the Indian Penal Code.

The learned advocate for the State opposes the prayer for bail and

submitted that petitioner had married for second time.

In view of the nature of allegations and the period of detention

suffered by the petitioner, I am of the opinion that further detention of

the petitioner is not necessary for the purpose of investigation.

Under such circumstances, I direct that the petitioner shall be

released on bail upon furnishing a bond of Rs. 10,000/- with two

sureties of Rs. 5,000/- each, one of whom must be local, to the

satisfaction of the Learned Additional Chief Judicial Magistrate,

Arambagh, Hooghly and on condition that he shall meet the

Investigation Officer once in a month until further orders or submission

of charge sheet whichever is earlier and on further condition that he

shall not intimidate the witnesses and tamper with evidence in any

manner whatsoever.

The application for bail is, thus, allowed.

Certified copy of this order, if applied for, be given to the parties

on priority basis.
