P.C. :

1. Heard learned Counsel for the parties.

2. This is an application under Section 24 of the Civil

Procedure Code whereby the applicant-wife is seeking

transfer of proceedings in Marriage Petition No. A-710 of

2017 pending before the learned Family Court, Nashik to the

Court of Civil Judge, Senior Division, Panvel.

3. It is the applicant’s case that, she left the matrimonial

home soon after marriage in 2016 and since then she is

residing at her parents house at Panvel. The husband has

filed this petition for dissolution of marriage in December,

2017. It is only thereafter, in January, 2018 the wife has

filed complaint against her husband under Section 498A of

the Indian Penal Code. In August, 2018 the wife has filed the

proceedings under the Domestic Violence Act. She has also

filed proceedings under Section 125 of the Criminal

Procedure Code in 2018. Thus, all the proceedings are filed

after the marriage petition was filed by the husband.

4. Be that as it may, the respondents are directed to take

instructions as to how much amount he will deposit with the

applicant which would meet her expenses for travelling

from Panvel to Nashik and to and fro. Stand over to 30th

January, 2019.
