The petitioner is the wife and the respondent her husband. This

petition has been filed under Section 24 of the Code of Civil Procedure for

transferring of the case bearing DMC/1125/ 2016

under Section 13 of the Hindu Marriage Act titled as ‘Baby Rani Vs. Natha Ram’

pending in the Court of Additional District Judge-I, Jalandhar to a Court of

competent jurisdiction at SBS Nagar (Nawanshahr).

Learned counsel for the petitioner states that the marriage of the

petitioner was solemnized with respondent in the year 2004. From this wedlock

two child were born. It is stated that the petitioner has been living at her parental

house since 2013. Out of two children, younger one namely, Jaideep Rattu is

staying with the petitioner and elder one is staying with the respondent. It is stated

that distance of Jalandhar is more than 60 kms. from SBS Nagar (Nawanshahr). It

is stated that the respondent is residing in SBS Nagar (Nawanshahr). The case

under Section 125 Cr.P.C. instituted by the petitioner is already pending at SBS

Nagar (Nawanshahr).

Learned counsel for the petitioner contends that the respondent is

already attending the Court proceedings in two other cases namely under the

Guardian and Wards Act and another petition under Section 9 of the Hindu

Marriage Act at SBS Nagar.

Considering the aforesaid facts and circumstances, this petition is

allowed. The case bearing DMC/1125/ 2016 under Section 13 of the Hindu

Marriage Act titled as ‘Baby Rani Vs. Natha Ram’ pending in the Court of

Additional District Judge-I, Jalandhar is ordered to be transferred to Family Court

at SBS Nagar (Nawanshahr).
