Heard learned counsel for the petitioner as well as learned

Public Prosecutor and also perused the material on record.

The petitioner has been arrested in connection with FIR

No.139/2017, Police Station Chitawa, District Nagaur for the

offence punishable under Sections 498A and Section304B of IPC. He has

preferred this interim bail application under Section 439 Cr.P.C.

Counsel for the petitioner submits that the father of the

accused petitioner is suffering from fourth stage lung cancer. He is

being treated with palliative chemotherapy. The petitioner may be

released on interim bail.

Learned Public Prosecutor has opposed the bail application.

Having regard to the totality of the facts and circumstances

of the case, I deem it just and proper to grant interim bail to the

accused petitioner under Section 439 Cr.P.C. for a period of ten

days to attend for look after and care for his father under police

custody.

Consequently, the interim bail application is allowed. It is

order that the accused-petitioner Bajrang Lal S/o Sohan Lal be

arrested in connection with F.I.R. No.139/2017, Police Station

Chitawa, District Nagaur shall be released on interim bail for a

period of ten days from the actual date of his release from prison

provided he furnishes a personal bond of Rs.50,000/- and two

surety bonds of Rs.25,000/- each to the satisfaction of the

concerned Superintend Central Jail, who shall be at liberty to

impose any other adequate condition for his surrender after expiry

of period of interim bail.
