Judgment / Order

Heard learned counsel for the accused-petitioner as well as

learned Public Prosecutor on the application for suspension of

sentence.

Accused-petitioner has been convicted for the offences under

Section 406 IPC and sentenced with simple imprisonment for one

year alongwith fine.

Learned counsel for the petitioner submits that the accused-

petitioner is in custody since 06.12.2017 when the lower appellate

Court rejected the appeal and he was also on bail during trial.

There is no other pending cases against the accused-petitioner.

Without commenting upon the merits of the case, I deem it

just and proper to suspend the sentence awarded to the accused-

petitioner.

Accordingly, the bail application for suspension of sentence is

allowed and it is ordered that the sentence passed by learned trial

court and affirmed by the learned Addl. Sessions Judge No.2,

Jaipur District Jaipur vide his judgment dated 06.12.2017 passed

in Criminal Appeal No.22/2017 (NCC No.127/17) 2017 against the

accused-petitioner Balaram S/o Onkar shall remain suspended till

final disposal of present revision petition provided he executes a

personal bond in the sum of Rs.40,000/- along with two sureties

in the sum of Rs.20,000/- each to the satisfaction of the trial court

for his appearance in this Court on 17.04.2018 and, as and when

called upon to do so.
