The petitioner is seeking regular bail in FIR No. 146 dated

08.05.2018, registered under Sections 376-D, 354 of IPC, Police Station

Khanna, District Ludhiana.

Counsel for the petitioner contends that the allegations of rape

have been levelled against others and the petitioner was not named in the

FIR and in the supplementary statement the victim had named him and

challan had been presented and the case had been adjourned thrice but

witnesses have not appeared to make their statement.

The petitioner is not named in the FIR. A supplementary

statement was given and the victim had corrected the name. The allegations

against the petitioner are under Section 354 IPC. The trial will take long

time to conclude. Without commenting upon the merits of the case, the

petition is allowed and the petitioner is directed to be released on regular

bail on execution of adequate personal and surety bonds to the satisfaction

of trial Court/Duty Magistrate.
