In Re: – An application for anticipatory bail under Section 438 of
the Code of Criminal Procedure filed on 19/10/2018 in
connection with Matigra P.S. Case No. 555 of 2018 dated
19/10/2018 under Sections 498A/304B/376/511 of the
Indian Penal Code.

It is submitted on behalf of the petitioner that he is the
father-in-law of the victim housewife and the allegation of
attempted rape is not supported by materials particulars with
regard to the date of the incident.
The learned counsel appearing on behalf of the State
opposes the prayer for anticipatory bail and submits that the
victim committed suicide within five years of her marriage.
Having considered the materials in the case diary and
bearing in the mind the nature of allegations and the extent of
complicity of the petitioner i.e. the father-in-law of the victim
housewife and in view of the aforesaid submissions made on
behalf of the petitioner, we we are inclined to grant anticipatory
bail to the petitioner.
In the event of arrest, the petitioner shall be released on
bail upon furnishing a Bond of Rs. 10,000/- with two sureties of
like amount each to the satisfaction of the Arresting Officer and
also subject to the conditions as laid down under Section 438(2)
of the Code of Criminal Procedure, 1973 and on further
condition that he shall meet the investigating officer once in a
week until further orders.
The application for anticipatory bail is, thus, disposed of.
