C.R.M. 7515 of 2018

Ct-34
(AD) In Re: – An application for bail under Section 439 of the Code of
Criminal Procedure filed on 10/09/2018 in connection with
Kalna P.S. Case No. 192/2018 dated 11/05/2018 under
Sections 498A/304B/302/34 of the Indian Penal Code and 3/4
of D.P. Act.

And

In the matter of: Basudev Pal Anr.

….petitioners.

Mr. Sk. Hossain Ali

…for the petitioners.

Mr. Anowar Hossain
Ms. Ratna Ghosh

…for the State.

The petitioners seek bail in connection with Kalna P.S.

Case No. 192/2018 dated 11/05/2018 under Sections

498A/304B/302/34 of the Indian Penal Code and 3/4 of D.P.

Act.

The petitioners are the parents-in-law of the victim who

suffered an unnatural death.

The husband of the victim is in custody.

The State produces the case diary and refers to the

general allegations of some of the neighbours to the effect that

the petitioners would torment and torture the victim in their

attempt to obtain more dowry.

However, there does not appear to be any material

immediately available which links the petitioners to the incident

that led to the unnatural death of the victim.

Accordingly, the petitioners are directed to be released on

bail upon furnishing bonds of Rs.10,000/- (Rupees Ten

Thousand only) each, with two sureties of like amount each, one

of whom must be local, to the satisfaction of the Additional Chief
2

Judicial Magistrate, Kalna, on condition that they shall not

intimidate the witnesses or tamper with the evidence in any

manner whatsoever and they shall appear before the trial court

on every date of hearing and in the event they fail to do so, the

trial court shall be at liberty to cancel their bail without further

reference to this Court.

The application for bail is, accordingly, allowed.

A certified copy of this order be immediately made

available to the petitioners, subject to compliance with all

requisite formalities.
