This application for anticipatory bail under sec.438 CrPC has

been filed by the petitioners apprehending their arrest in

connection with FIR No.107/2021, registered at Police Station

Dhorimanna, District Barmer for offences punishable under secs.

498A, 323 342 IPC.

Heard learned counsel for the petitioners as well as learned

Public Prosecutor and perused the material available on the

record.

Learned counsel for the petitioners submits that that

petitioners had joined investigation on 05.07.2021; petitioners are

father-in-law and mother-in-law of victim; the victim and her

husband are living together; as per injury report there are two

abrasions and one swelling found on body of the victim, which

were not caused by the petitioners; petitioners have falsely been

implicated in this case. Learned counsel for the petitioner prays to

enlarge the petitioners on anticipatory bail.

Learned Public Prosecutor has opposed grant of anticipatory

bail to the petitioners.

Having considered rival contentions of the learned counsel

for the parties and material available on record, in the facts and

circumstances of the case, without expressing any opinion on

merits of the case, this Court deems it just and proper to grant

anticipatory bail to the accused-petitioners under sec.438 CrPC.

Accordingly, this bail application under sec.438 CrPC is

allowed and it is ordered that in the event of arrest of petitioners

(1) Bhaga Ram S/o Veerma Ram, and (2) Ladha Devi W/o Bhaga

Ram, who are in custody in connection with FIR No.107/2021,

Police Station Dhorimanna, District Barmer, they shall be enlarged

on bail provided each of them executes a personal bond in the

sum of Rs.1,00,000/- with two sound solvent sureties of

Rs.50,000/- each, to the satisfaction of concerned I.O./S.H.O. on

the following conditions:

1) They shall make themselves available for interrogation
by the Investigation Officer as when required;

2) They shall not directly or indirectly make any
inducement, threat or promise to any person
acquainted with the facts of the case so as to dissuade
him from disclosing such facts to the court or to any
Police officer;

3) They shall not leave India without prior permission of
the court.
