1. Heard learned counsel for the Applicant.

2. By this application, the Applicant seeks transfer of Sessions

Case No.237 of 2017 from the Sessions Court at Nashik to the Sessions

Court at Pune; or the Sessions Court at Satara ; or the Sessions Court at

Kolhapur.

3. Learned Counsel for the Applicant submitted that the

Applicant is the complainant in the said case, who has lodged a case, as

against the Respondent Nos.1 to 3, alleging offences punishable under

Sections 304B, 406 and 498A of the Indian Penal Code. The witnesses are

from Kolhapur, Pune, Navi Mumbai and Sangli. She submitted that it

would be convenient for the Applicant as well as the witnesses, if the case is

transferred from Nashik to either Pune, Satara or Kolhapur. She further

submitted that Respondent Nos.1 and 2 are influential people. She submits

that no prejudice will be caused to the Respondent Nos.1 to 3 – Accused, if

the case is transferred from Nashik. She further submits that till date, charge

has not been framed in the said case.

4. Issue notice to the respondents, returnable on 30th April, 2019.

Hamdast permitted. Learned APP waives notice on behalf of the

Respondent No.4-State. In addition to Court notice, Advocate for the

Applicant, to serve the Respondent Nos. 1 to 3, by Advocate’s notice and

file an affidavit of service before the returnable date.
