ORDER

The petitioners herein have been arrayed as accused

Nos.1 to 3 among the 3 accused in the instant Crime

No.360/2019 of Bekal Police Station, Kasargode District,

which has been registered for offences punishable under

Sec.498A of the SectionI.P.C, on the basis of the FI statement given by

the lady de facto complainant on 12.9.2019 at about 3:20 p.m.,

in respect of the incidents happened for the period from

20.12.2015 to 3.8.2019. The lady de facto complainant is the

wife of the 1st petitioner herein and petitioners 2 3 are the

father and mother respectively of the 1st petitioner.

2. The brief of the prosecution case is that after the

marriage between the spouses, the petitioners have treated the

de facto complainant with cruelty, demanding dowry, money,

etc.

3. Sri.Amjad Ali, learned Prosecutor would fairly

submit on the basis of instructions from the Investigating
::3::

Officer concerned that pursuant to Sec.41A notice issued, the

1st petitioner (A1) appeared before the Investigating Officer for

interrogation purposes and he has fully co-operated with the

interrogation process and that the Investigating Officer does

not intend to arrest any of the petitioners in relation to the

investigation in this Crime.

4. The abovesaid submission made on behalf of the

Investigating Officer is recorded. Hence it is for the

petitioners to work out their remedies in the manner known to

law as the plea for anticipatory bail has become rather

redundant or infructuous in view of the fair stand taken by the

Investigating Officer concerned.

With these observations and directions, the above

application will stand disposed of.
