ORAL ORDER

1. By way of the present application, the applicant has
prayed for the following relief:-

“15(B). Pass appropriate order under Section 482 of the
Code of Criminal Procedure and be pleased to F.I.R.
being I-C.R.No.17 of 2018 registered with Mahila Police
Station, District: Banaskantha for the alleged offences
punishable under Sections 498A, 323, 294(B), 506(2)
and 114 of the Indian Penal Code, as well as Sections 3
and 7 of the Prohibition of Dowry Act, dated 02.11.2018
and the resultant charge-sheet and Criminal Case
No.5629 of 2018 on the file of the learned Chief Judicial
Magistrate, Palanpur, District: Banaskantha, qua the
present petitioner, in the interest of justice.”

2. It appears that the chargesheet is filed in the matter.

3. Having heard submissions made at bar and considering
the averments made in the present application, no case is
made out to entertain the present application without availing
alternate remedy to file discharge application. Therefore, the
present application is not entertained at this stage. However,

the applicant is at liberty to file discharge application and also
to file appropriate proceedings either u/s 397 or 482 of the
Code of Criminal Procedure, 1973 before appropriate
competent Court, after remedy to file discharge application is
availed.

4. It is clarified that this Court has not examined the merits
of the present application.
