This is an application, filed under Section 438 Cr.PC, praying for pre-arrest
bail of the petitioner, namely, Sri Bibhav Urang, in connection with Sarupathar PS
Case No. 146/2018 under Section 354 IPC read with Section 8 POCSO Act.

Heard Mr. S. Munir, learned counsel for the petitioner as well as Ms. A. Begum,
learned Additional Public Prosecutor for the state respondent.

Case diary produced has been perused including the statement of the victim
available in the case diary.

Considering the materials in the case diary, particularly the statement of the
victim, this does not appear to be a case where custodial interrogation of the petitioner
is necessary, and accordingly, his prayer is allowed.

The petitioner shall appear before the investigating officer within 7 (seven) days
from today so as to enable the investigating officer to record his statement, and, in the

event of his arrest, he shall be released on furnishing a bail bond of Rs. 15,000/- with
one surety of like amount to the satisfaction of the arresting authority, on the following
conditions:

(1) The petitioner shall not leave the territorial jurisdiction of
the aforesaid police station, without prior written permission from its
officer-in-charge,
(2) The petitioner shall not hamper with the investigation, or
tamper with the evidence of the case, and
(3) The petitioner shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the facts of
the case so as to dissuade him from disclosing such facts to the Court or
to any police officer.

The petition stands disposed of.
