It is found from the record that vide order dated 7 th
March, 2014, this Court directed the Secretary, Calcutta
High Court Legal Services Authority to appoint a lawyer
from the State panel to defend the cause of the convict
immediately. The next order dated 14 th March, 2014
shows that Mr. P. K. Roy, advocate was appointed in the
instant matter by the High Court Legal Services
Authority.
Subsequently, however, he did not appear. It is
found from the copy of the impugned judgment and
order of conviction and sentence passed on 27 th
November, 2013 by the learned Additional Sessions
Judge, Fast Track Court, Balurghat, Dakshin Dinajpur
that the appellant was convicted and sentenced to suffer
rigorous imprisonment for three years with fine and
default clause for committing offence under Sections
498A/34 of the Indian Penal Code. He was further

sentenced to suffer imprisonment for five years for
committing offence under Sections 306/34 of the Indian
Penal Code. The appellant filed the instant appeal while
he was in custody to serve out the sentence. In the
meantime the entire period of sentence has elapsed.
Therefore, this Court wants to ascertain as to
whether the appellant is still willing to proceed with the
appeal or not.
Since Mr. Roy never appeared in the instant appeal
but for once, this Court appoints Mr. Dipanjan Dutt,
learned advocate from the panel of the High Court Legal
Services Authority.
Let a copy of this order be sent to the learned
Registrar, Original Side for regularization of the
appointment of Mr. Dutt.
Mr. Dutt is requested to go through the instant
appeal.
The office is requested to make a photocopy of the
entire brief and hand over the same to Mr. Dutt by 22 nd
July, 2021.
A copy of this order be also sent to the Hon’ble
Chairman, High Court Legal Services Authority to
apprise the fact that even after acceptance of the order of
appointment, the learned advocate did not even take
step for admission of the instant appeal.
