Issue notice to respondent no.2.
Steps be taken within a week.
It is argued by learned counsel for the
applicant that the applicant has falsely been
implicated in the crime; false FIR has been
lodged by the respondent no.2 and as per the
FIR no offence is made out against him under
Section 354 IPC.

Learned counsel for the State prays for
and is granted four weeks’ time to file counter
affidavit.

List thereafter.

In view of the above, it is directed that till
the next date of listing, further proceedings of
criminal case no.363 of 2018, “State Vs. Swami
Rameshwar Das”, under Section 354 IPC
pending before the lower Court against the
present applicant shall remain stayed.

Stay application stands disposed of.
