HON’BLE MR. JUSTICE P.K. LOHRA
Order
09/05/2017
Accused-petitioner has filed this petition under Section 482
Cr.P.c. for seeking undermentioned directions:
“It is therefore prayed that, this petition may
kindly be allowed and a direction be issued to
Additional magistrate (PCPNDT) (SD) Jodhpur
Metro to conclude the trial of criminal case
No.6/2014 within 6 months. Any other relief
favorable to the petitioner may kindly be granted”
It is submitted by learned counsel for the petitioner that trial
against petitioner for offence under Sections 498A 406 IPC is
pending before Special Additional Chief Judicial Magistrate
(P.C.P.N.D.T.) Act, Jodhpur Metropolitan (for short, ‘learned trial
Court’) for last almost three years. It is also argued by learned
counsel that so far there is no material progress in the trial
inasmuch as only one prosecution witness has been examined.

[CRLMP-79/2017]
Per contra, learned Public Prosecutor submits that no general
directions can be issued for expediting trial.
Having heard learned counsel for the parties, in my opinion,
no specific directions can be issued to learned trial Court for
expediting trial in the matter. However, it is expected of the
learned trial Court to proceed with trial as expeditiously as
possible and conclude the same at the earliest.
