Heard learned counsel for the petitioners, learned Public

Prosecutor as well as learned counsel for the complainant and

perused the record available on record.

The petitioners have been arrested in connection with FIR

No.49/2019 of P.S. Sidhmukh, District Churu for the offences

punishable under Sections 304B, 498A and 34 I.P.C. They have

preferred this bail application under Section 439 Cr.P.C.

Learned counsel for the petitioners has submitted that the

petitioners are mother-in-law and father-in-law of the deceased.

It is also submitted that allegations of demand of dowry and

harassment levelled against the petitioners are absolutely false. It

is argued that daughter of the petitioners was married to brother

of the deceased and in such circumstances, it is difficult to

comprehend that there was any demand of dowry on the part of

the petitioners. Learned counsel for the petitioners has submitted

that charge-sheet has been filed and trial of the case will take

time.

Learned Public Prosecutor as well as learned counsel for the

complainant have vehemently opposed the bail application.

Having regard to the totality of the facts and circumstances

of the case, without expressing any opinion on the merits of the

case, I deem it just and proper to grant bail to the accused

petitioners under Section 439 Cr.P.C.

Accordingly, this bail application filed under Sec.439 SectionCr.P.C. is

allowed and it is directed that petitioners No.1 Chandrabhan S/o

Moola Ram and No.2 Kalawati W/o Chandrabhan shall be released

on bail in connection with FIR No.49/2019 of P.S. Sidhmukh,

District Churu provided each of them executes a personal bond in

a sum of Rs.50,000/- with two sound and solvent sureties of

Rs.25,000/- each to the satisfaction of learned trial court for

his/her appearance before that court on each and every date of

hearing and whenever called upon to do so till the completion of

the trial.
