Serial No.292(M/L).

CRM 8113 of 2018

In Re. An application for anticipatory bail under
Section 438 of the Code of Criminal Procedure.

In the matter of:

Chinmoyee Koner @ Chinmoyee Kongar and another

-versus-

The State of West Bengal

Mr Tapas Kumar Ghosh
Mr A. Chakraborty
Mr S. Pan
… for the petitioners.

Ms Baisali Basu
… for the State.

The petitioners seek anticipatory bail in connection with
Goghat Police Station Case No.87 of 2018 dated April 19, 2018
under Sections 498A/302/34 of the Indian Penal Code.

Changed circumstances have been cited to move this second
petition. The complaint was filed under Section 302 but the charge-
sheet now filed reduces the offence to Section 306 of the Penal
Code.

There does not appear to be a case of demand for dowry under
Section 498A.

Since the case is now of suicide and the petitioners may not
have been involved in the incident leading to the death of the victim,
the petitioners are granted anticipatory bail.

Accordingly, in the event of arrest, the petitioners are directed
to be released on bail upon furnishing bonds of Rs.10,000/-
(Rupees Ten Thousand Only) each, with two sureties of Rs.5,000/-
(Rupees Five Thousand Only) each, one of whom must be local, to
the satisfaction of the arresting officer, subject to the conditions laid
down in Section 438(2) of the Code of Criminal Procedure, 1973. In
addition, the petitioners will attend the trial court regularly on each
and every occasion unless prevented by sufficient cause.

The petition for anticipatory bail is disposed of on the
conditions indicated above.

A certified copy of this order be immediately made available to
the petitioners, subject to compliance with all requisite formalities.
