The petitioner no.1, namely, Nishank Lakkar and the
opposite party no.2, namely, Smt. Neha Lakkar are personally
present in Court today.
The revisional application being C.R.R. No. 1933 of 2019
has been filed by the husband seeking quashing of Belghoria
Police Station Case No. 371 of 2017 under Sections 406/Section506 read
with Section 34 of the Indian Penal Code.
C.R.R. No. 1934 of 2019 the quashing of G.R. Case No. 3420
of 2016 under Sections 498A/Section325 of the Indian Penal Code read
with Sections 3/Section4 of the Dowry Prohibition Act, 1961 arising out
of Belghoria Police Station Case No. 426 of 2016 dated June 5,
2016 has been filed.
The parties are personally present in Court today and jointly
submit that with the assistance of a third party, namely, Human

Rights Organization and/or NGO, they have amicably settled their
disputes and differences.
The parties have annexed a copy of the Memorandum of
Understanding dated 7th April, 2019 duly signed by themselves i.e.
Nishant Lakkar and Neha Lakkar and duly witnessed whereby and
under the compromise and/or settlement has been effected of
their mutual disputes and differences.
The sum and substance of their submissions is that the
parties have agreed to separate by filing an application for divorce
by mutual consent.
In those circumstances, this Court accepts the submissions
made by the respective parties notwithstanding the fact that a
joint compromise petition has not been filed in Court.
The aforesaid proceedings being Belghoria Police Station
Case No. 371 of 2017 under Sections 406/Section506 read with Section
34 of the Indian Penal Code and G.R. Case No. 3420 of 2016 now
pending before the learned Additional Chief Judicial Magistrate,
Barrackpore, North 24 Parganas shall stand quashed and set
aside.
These revisional applications are disposed of.
Urgent photostat certified copy of this order, if applied for,
be supplied to the parties as early as possible.
