The applicant, who is a convict and has

been convicted and sentenced to undergo simple

imprisonment for a period of six months and also to

pay fine of `1000/- under Section 342 IPC, rigorous

imprisonment for a period of one year and to pay a fine

of `3000/-, under Section 354 IPC, rigorous

imprisonment for a period of two years and to pay a

fine of `3,000/- under Section 452 IPC, and rigorous

imprisonment for three years and to pay a fine of

`5,000/-, under Section 8 of the Protection of Children

from Sexual Offences Act, 2012, has filed this

application for suspension of sentence so awarded

against him by learned Special Judge (POCSO), Shimla,

District Shimla vide judgment dated 21.4.2018 in

Sessions Trial RBT No.12-S/7 of 2017. Learned counsel

representing the appellant submits that the amount of

fine stands deposited in the trial Court. He was on bail

during the course of trial. Therefore, I accept this


application. Consequently, the sentence awarded

against the applicant-convict shall remain suspended

during the pendency of the appeal, subject to his

furnishing personal bond in the sum of `20,000/- with

one surety in the like amount to the satisfaction of

learned trial Judge within four weeks undertaking

specifically that in the event of dismissal of the appeal,

he shall surrender to serve out the sentences imposed

upon him. The application stands accordingly disposed
