ORDER

1.Petitioners are accused 3 and 4 in crime

No.1429/2018 of Venjaramoodu police station in

Thiruvunanthapuram district. The offence alleged

against them is one punishable under Sec.498A of
IPC. They seek bail under Sec.438 of Cr.P.C.

2.Heard Sri.T.A.Prakash, the learned counsel for the

petitioners and Sri.D.Chandrasenan, the learned

public prosecutor.

3.There are altogether four accused persons. The

petitioners are accused 3 and 4. The prosecution

case is that the 1st informant was subjected to

cruelty and harassment by all the accused persons.

The learned counsel for the petitioners showed me

the order of this court in B.A.8357/2018. As per the

said order this court granted bail under Sec.438 of

Cr.P.C to the husband and mother-in-law of the 1 st

informant. There is no reason why similar treatment

is not extended to the petitioners who are only

distant relatives of the other accused persons.

4.The application is allowed. If arrested in

connection with crime No.1429/2018 of Venjaramoodu

police station in Thiruvananthapuram district, the

petitioners shall be released on bail after

interrogation, if any, on their executing bonds for

Rs 40,000/- (forty thousand only) with two solvent

sureties each for the like sum to the satisfaction

of the investigating officer. The petitioners shall

co-operate with the investigation. They shall make

themselves available for interrogation if so

required by the investigating officer. The

petitioners shall not intimidate or attempt to

influence witnesses. Nor shall they destroy evidence

or tamper with it. Nor shall they attempt to

interfere with the investigation. The learned
magistrate having jurisdiction is hereby empowered

to cancel the bail in accordance with law if any of

the conditions mentioned above is violated.
