ORDER

The petitioner is the sole accused in Crime No.06/2019

of Kalladikkode Police Station, for allegedly committed

offences punishable under Sections 323,324,294(b), 498A

and 506(ii) r/w 34 I.P.C.

2. The prosecution case in brief is that, the de facto

complainant, who is the wife of the petitioner, also a police

officer herself by profession was assaulted on 03.01.2019 by

the petitioner and that she has been constantly harassed,

physically and mentally by the petitioner. The defacto

complainant sustained some injury; and on her complaint,

the case has been registered against him. The allegation is

that the petitioner had hit her with the keys of a car. The

petitioner and the de facto complainant has been married

since 23/06/2002. No custodial interrogation of the

petitioner is found essential. There is no recovery to be

made. The petitioner had undertaken to co-operate with

the investigation and hence the petitioner is entitled to the

anticipatory bail.

In the result, the petition is allowed and in the event of

the petitioner being arrested, he shall be released on bail on

executing a bond for Rs.50,000/- with two solvent sureties

each for the like sum to the satisfaction of the investigating

officer. The petitioner shall appear before the investigating

officer as and when call for and shall co-operate with the

investigation. He shall not intimidate or influence the

de facto complainant. He shall not get involved in any other

similar offences during the bail period.
