The accused petitioners have assailed the criminal proceeding being G.R.

Case No.473 of 2015 arising out of Jorasanko P.S. Case No.122 of 2015 dated

17th February, 2015 under Sections 498A/Section406/Section354/Section34 of the IPC read with

Sections 3 and Section4 of the Dowry Prohibition Act, 1961 pending before the learned

Metropolitan Magistrate, 15th Court, Calcutta inter alia, on the ground stated in

the petition.

Now the parties to the case have entered into a compromise by filing an

application being CRAN 2077 of 2019 with the similar prayer for quashing of the

proceeding in view of the settlement arrived at between the parties mainly the

husband and the wife. The terms of settlement has been embodied in paragraph

6 of the petition.

Having heard learned advocates for the parties including the learned P.P.

appearing for the State respondent and in consideration of the compromise

having arrived at between the parties and the deposition of the wife before the

learned Magistrate in miscellaneous case, further continuation of the proceeding

under reference will be futile exercise and abuse of the process of the court.

The application being CRR 1368 of 2019 stands allowed.

Accordingly, the criminal proceeding being G.R. Case No.473 of 2015

arising out of Jorasanko P.S. Case No.122 of 2015 dated 17th February, 2015

under Sections 498A/Section406/Section354/Section34 of the IPC read with Sections 3 and Section4 of the

Dowry Prohibition Act, 1961 pending before the learned Metropolitan Magistrate,

15th Court, Calcutta is quashed.

The application being CRAN 2077 of 2019 is also disposed of.

Urgent photostat certified copy of this order, if applied for, shall be given to

the parties as expeditiously as possible.
