This is an application under Sections 401 and Section482 of the
Code of Criminal Procedure read with SectionArticle 227 of the Constitution
of India filed by the petitioner challenging the order dated February
26, 2019 passed by the learned Judicial Magistrate, 2nd Court,
Barrackpore in G.R. Case No. 3549 of 2015 arising out of Noapara
Police Station Case No. 183 of 2015 dated 27.06.2019 under
Sections 498A/Section406/Section34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner
submits that petitioner has approached before this Court for early
disposal of the criminal proceedings pending against her.
I have gone through the impugned order dated 26.02.2019
wherefrom it appears that the petitioner preferred an application
under Section 205 of the Code of Criminal Procedure and the
learned Magistrate has fixed on 20.02.2020 for hearing of that
application.
In the above situation, I think justice would be sub-served if a
specific direction is given to the learned Magistrate to dispose of the
said application under Section 205 of the Code of Criminal
Procedure on the next date fixed by the learned Magistrate that is on
20.02.2020 or within 30 days from the date of communication of this
order.
Before parting with the case it appears that the case is
pending since 2015.
The learned Magistrate is further requested to dispose of the
criminal proceeding arising out of G.R. Case No. 3549 of 2015 as
early as possible preferably within a period of one year from the date

of communication of this order without granting any unnecessary
adjournment to either of the parties.
Thus the revisional application being C.R.R. 3875 of 2019 is
disposed of.
Let a copy of this order be communicated to the learned
Court below forthwith.
