thatatfirstinstancecomplainant(hereinafterreferredto

astheprosecutrix)lodgedZeroFIRNo.55atpoliceStation,

YamunaNagar(Haryana),whichsubsequentlycametobe

transferredtopoliceStation,Kandaghat,DistrictSolan,H.P.

OnthebasisofaforesaidZeroFIR,policeStation,Kandaghat

lodgedfreshFIRNo.81of2018,dated26.9.2018under

Sections376IPC,whichfurthercametobetransferredto

policeStation,Dhali,DistrictShimla,H.P.Policestation,

Dhali(Shimla)lodgedFIRNo.39of2019,dated8.3.2019under

Sections376andSection417ofIPCagainstthepetitioner/accused.

Prosecutrixallegedthatshemetpetitioner/accusedinashop

atYamunaNagarandthereaftertheybothdevelopedintimacy

andstartedtalkingtoeachother.Aftersometime,prosecutrix

wentabroad,butsubsequentlyshecamebacktothiscountry

ontheinsistenceofbailpetitioner,whoinsistedherfor

marriage.Allegedly,on17thMay,2018bothpetitionerand

prosecutrixgotengagedwitheachotherinaceremonyheld

inthepresenceoftheirfamilymembersatBuffetHutHotel

YamunaNagar(Haryana).On18thMay,2018,entirefamilyof

thepetitioner/accusedalongwithprosecutrixcametoChail,

DistrictSolan(HP),wherebailpetitionerallegedlyonthe

pretextofmarriagecompelledtheprosecutrixtohave

intercoursewithhim.Though,marriagewasfixedtobe

solemnizedon13thDecember,2018andallthearrangements

weremade,butsuddenlyon18th/19thSeptember,2018bail

petitionerrefusedtosolemnizemarriagewiththeprosecutrix

andshewascompelledtolodgecomplaintatWomenpolice

Station,YamunaNagar(Haryana)on20thSeptember,2018.

Onthebasisofaforesaidstatementhavingbeenmadebythe

prosecutrix,ZeroFIR,referredhereinabove,cametobelodged

againstthebailpetitioneratYamunaNagar.Sincealleged

offence,ashasbeentakennotehereinabove,allegedlycameto

becommittedatChail,DistrictSolan,HimachalPradesh,Zero

4.Mr.VinayKuthiala,learnedcounselrepresenting

thebailpetitionerwhilereferringtotherecord/statusreport,

strenuouslyarguedthatbareperusalofthereportlodgedby

theprosecutrixitselfrevealsthatsheofherownvolition

joinedthecompanyofbailpetitioner,whosubsequentlywith

aviewtohelpherofferedtomarryherdespiteherstigmatic

past.Mr.Kuthiala,furthercontendedthatthereisnothing

ontherecordtodemonstratethatprosecutrixwasdupedby

thebailpetitioner,ratherherownstatementclearlysuggests

thatpetitionerwasreadyandwillingtosolemnizemarriage

withtheprosecutrix,whowassubsequentlyfoundtobe

alreadymarried.Lastly,Mr.Kuthiala,contendedthatsince

investigationinthecaseiscompleteandnothingisrequired

toberecoveredfromthebailpetitioner,nofruitfulpurpose

wouldbeservedincasebailpetitionerissentforcustodial

interrogation.

5.Mr.SanjeevSood,learnedAdditionalAdvocate

General,whileopposingtheinstantbailpetitionfiledon

behalfofthebailpetitionerthoughadmittedthefactumwith

regardtocompletionoftheinvestigation,butcontendedthat

keepinginviewthegravityofoffenceallegedtohavebeen

committedbythebailpetitioner,hedoesnotdeserveany

leniency,ratherneedstobedealtwithseverely.While

invitingattentionofthisCourttotherecord/statusreport,Mr.

Sood,madeanattempttopersuadethisCourttoagreewith

hiscontentionthatbailpetitionertakingundueadvantageof

theinnocenceoftheprosecutrixsexuallyassaultedheragainst

herwishesonthepretextofmarriage.Mr.Sood,further

contendedthatintheeventofpetitioner’sbeingenlargedon

bail,thereiseverylikelihoodofhisfleeingfromjusticeandas

such,presentbailpetitionmaybedismissed.

6.Havingheardlearnedcounselrepresentingthe

partiesandperusedthematerialavailableonrecord,this

Courtfindsthatallegedincidenthadtakenplaceon17th/18th

May,2018,whereasFIRcametobelodgedon20thSeptember,

2018i.e.approximatelyafter3½months.Though,inthecase

athandprosecutrixhasstatedthaton19thSeptember,2018

bailpetitionerrefusedtosolemnizemarriage,butifher

statementisreadinitsentirely,itclearlysuggeststhat

immediatelyafterengagement,bailpetitionerhadexpressed

hisunwillingnesstosolemnizemarriagewithherandassuch,

prosecutrixoughttohavereportedthemattertothepoliceat

firstinstance.

7.Leavingeverythingaside,thereissufficient

materialavailableonrecordindicativeofthefactthatbail

petitionerandprosecutrixwerenotonlyknowntoeachother

forconsiderabletime,buttheyhadalsodevelopedproximity

witheachotherandassuch,itcannotbebelievedthatbail

petitionertakingundueadvantageofinnocenceofthe

prosecutrixcompelledhertohaveintercoursewithhimonthe

pretextofmarriage.Asperownstatementoftheprosecutrix,

allthearrangementsformarriageweremade,meaning

thereby,bothpetitionerandprosecutrixwerewillingto

marriageeachotherandassuch,itcannotbesaidthatbail

petitionerdupedtheprosecutrix,rathermaterialavailableon

recordindicatesomethingelse.Materialplacedonrecordby

thebailpetitioner,whichisnotrefutedbytherespondent­

State,compelthisCourttoagreewiththecontentionof

learnedcounselrepresentingthebailpetitionerthatsince

prosecutrixwasalreadymarried,bailpetitioner,who

admittedlyspenthisownmoneyforcallingtheprosecutrix

fromtheaboardhadnooptionbuttorefuseformarriage.

Materialavailableonrecordclearlyrevealthatprosecutrixin

oneoftheproceedingbeforetheHighCourtofPunjaband

Haryanastatedthatsheofherownjoinedthecompanyofthe

person,namelyAshishTyagi,whosubsequentlysolemnized

marriagewithher,meaningtherebyprosecutrixwasalready

marriedatthetimeofherengagementwiththebail

petitioner.

8.Though,aforesaidaspectsofthematteraretobe

consideredanddecidedbythelearnedtrialCourtonthebasis

oftotalityofevidencetobecollectedonrecordbythe

InvestigatingAgencyduringthetrial,buthavingcarefully

perusedtherecord,whichhasbeenotherwisetakennote

hereinabove,thisCourtseesnojustificationtoallowthebail

petitionertoincarcerateinjailforanindefiniteperiod,

especiallywheninvestigationiscompleteandnothingis

requiredtoberecoveredfromhim.

9.Hon’bleApexCourtaswellasthisCourtin

catenaofcaseshaveheldthatfreedomofanindividual

cannotbecurtailedforindefiniteperiodduringthependency

ofthetrialbecauseoneisdeemedtobeinnocentuntilhis/her

guilt,isnotprovedinaccordancewithlaw.Inthecaseat

hand,guilt,ifany,ofthebailpetitionerisyettobeprovedin

accordancewithlawbyleadingcogentandconvincing

evidence.ApprehensionexpressedbylearnedAdditional

AdvocateGeneralthatintheeventofpetitioner’sbeing

enlargedonbail,hemayfleefromjustice,canbebestmetby

puttingbailpetitionertostringentconditions,ashasbeen

fairlystatedbylearnedcounselrepresentingthebail

petitioner.

10.Recently,theHon’bleApexCourtinCriminal

AppealNo.227/Section2018,DataramSinghvs.StateofUttar

PradeshAnr.,decidedon6.2.2018,hascategoricallyheld

thatafundamentalpostulateofcriminaljurisprudenceisthe

presumptionofinnocence,meaningtherebythatapersonis

believedtobeinnocentuntilfoundguilty.Hon’bleApexCourt

furtherheldthatwhileconsideringprayerforgrantofbail,it

isimportanttoascertainwhethertheaccusedwas

participatingintheinvestigationstothesatisfactionofthe

investigatingofficerandwasnotabscondingornotappearing

whenrequiredbytheinvestigatingofficer.Hon’bleApexCourt

furtherheldthatifanaccusedisnothidingfromthe

investigatingofficerorishidingduetosomegenuineand

expressedfearofbeingvictimized,itwouldbeafactorthata

judgewouldneedtoconsiderinanappropriatecase.The

relevantparasoftheaforesaidjudgmentarereproducedas

under:

2.Afundamentalpostulateofcriminal

jurisprudenceisthepresumptionofinnocence,
meaningtherebythatapersonisbelievedtobe
innocentuntilfoundguilty.However,thereare

instancesinourcriminallawwhereareverse
onushasbeenplacedonanaccusedwith
regardtosomespecificoffencesbutthatis
anothermatteranddoesnotdetractfromthe
fundamentalpostulateinrespectofother
offences.Yetanotherimportantfacetofour
criminaljurisprudenceisthatthegrantofbail
isthegeneralruleandputtingapersoninjail
orinaprisonorinacorrectionhome
(whicheverexpressiononemaywishtouse)is
anexception.Unfortunately,someofthese
basicprinciplesappeartohavebeenlostsight
ofwiththeresultthatmoreandmorepersons

arebeingincarceratedandforlongerperiods.
Thisdoesnotdoanygoodtoourcriminal
jurisprudenceortooursociety.

3.Thereisnodoubtthatthegrantordenialof

.

bailisentirelythediscretionofthejudge

consideringacasebutevenso,theexerciseof
judicialdiscretionhasbeencircumscribedbya
largenumberofdecisionsrenderedbythis

CourtandbyeveryHighCourtinthecountry.
Yet,occasionallythereisanecessityto
introspectwhetherdenyingbailtoanaccused
personistherightthingtodoonthefactsand

inthecircumstancesofacase.

4.Whilesointrospecting,amongthefactors
thatneedtobeconsiderediswhetherthe
accusedwasarrestedduringinvestigations

whenthatpersonperhapshasthebest

opportunitytotamperwiththeevidenceor
influencewitnesses.Iftheinvestigatingofficer
doesnotfinditnecessarytoarrestanaccused
personduringinvestigations,astrongcase

shouldbemadeoutforplacingthatpersonin
judicialcustodyafterachargesheetisfiled.
Similarly,itisimportanttoascertainwhether
theaccusedwasparticipatinginthe

investigationstothesatisfactionofthe
investigatingofficerandwasnotabsconding

ornotappearingwhenrequiredbythe
investigatingofficer.Surely,ifanaccusedis

nothidingfromtheinvestigatingofficeroris
hidingduetosomegenuineandexpressedfear
ofbeingvictimised,itwouldbeafactorthata
judgewouldneedtoconsiderinanappropriate
case.Itisalsonecessaryforthejudgeto
considerwhethertheaccusedisafirst­time
offenderorhasbeenaccusedofotheroffences
andifso,thenatureofsuchoffencesandhisor
hergeneralconduct.Thepovertyorthedeemed
indigentstatusofanaccusedisalsoan
extremelyimportantfactorandeven
Parliamenthastakennoticeofitby
incorporatinganExplanationtoSection436of
theCodeofCriminalProcedure,1973.An

equallysoftapproachtoincarcerationhas
beentakenbyParliamentbyinsertingSection

5.Toputitshortly,ahumaneattitudeis

requiredtobeadoptedbyajudge,while

dealingwithanapplicationforremandinga
suspectoranaccusedpersontopolicecustody
orjudicialcustody.Thereareseveralreasons

forthisincludingmaintainingthedignityof
anaccusedperson,howsoeverpoorthatperson
mightbe,therequirementsofSectionArticle21ofthe
Constitutionandthefactthatthereis

enormousovercrowdinginprisons,leadingto
socialandotherproblemsasnoticedbythis
CourtinInRe­InhumanConditionsin1382
Prisons

11.TheHon’bleApexCourtinSanjayChandra

versusCentralBureauofInvestigation(2012)1Supreme

CourtCases49;heldasunder:­

“Theobjectofbailistosecurethe
appearanceoftheaccusedpersonathistrial

byreasonableamountofbail.Theobjectof
bailisneitherpunitivenorpreventative.

Deprivationoflibertymustbeconsidereda
punishment,unlessitcanberequiredto
ensurethatanaccusedpersonwillstandhis

trialwhencalledupon.TheCourtsowemore
thanverbalrespecttotheprinciplethat
punishmentbeginsafterconviction,andthat
everymanisdeemedtobeinnocentuntilduly
triedanddulyfoundguilty.Detentionin
custodypendingcompletionoftrialcouldbe
acauseofgreathardship.Fromtimetotime,
necessitydemandsthatsomeunconvicted
personsshouldbeheldincustodypending
trialtosecuretheirattendanceatthetrial

anycircumstances,heshouldbedeprivedof

hislibertyupononlythebeliefthathewill
tamperwiththewitnessesifleftatliberty,
saveinthemostextraordinarycircumstances.

Apartfromthequestionofpreventionbeing
theobjectofrefusalofbail,onemustnotlose
sightofthefactthatanyimprisonment
beforeconvictionhasasubstantialpunitive

contentanditwouldbeimproperforany
courttorefusebailasamarkofdisapproval
offormerconductwhethertheaccusedhas
beenconvictedforitornotortorefusebailto

anunconvictedpersonfortheproposeof

givinghimatasteofimprisonmentasa
lesson.”

12.Needlesstosayobjectofthebailistosecurethe

attendanceoftheaccusedinthetrialandthepropertesttobe

appliedinthesolutionofthequestionwhetherbailshouldbe

grantedorrefusediswhetheritisprobablethatthepartywill

appeartotakehistrial.Otherwise,bailisnottobewithheld

asapunishment.Otherwisealso,normalruleisofbailand

notjail.Courthastokeepinmindnatureofaccusations,

natureofevidenceinsupportthereof,severityofthe

punishmentwhichconvictionwillentail,characterofthe

accused,circumstanceswhicharepeculiartotheaccused

involvedinthatcrime.

496,haslaiddownthefollowingprinciplestobekeptinmind,

whiledecidingpetitionforbail:

(i)whetherthereisanyprimafacieor
reasonablegroundtobelievethatthe
accusedhadcommittedtheoffence;

(ii)natureandgravityoftheaccusation;

(iii)severityofthepunishmentintheeventof
conviction;

(iv)danger
roftheaccusedabscondingor

fleeing,ifreleasedonbail;

(v)character,behaviour,means,positionand
standingoftheaccused;

(vi)likelihoodoftheoffencebeingrepeated;

(vii)reasonableapprehensionofthewitnesses
beinginfluenced;and

(viii)danger,ofcourse,ofjusticebeing
thwartedbygrantofbail.

14.Consequently,inviewoftheabove,orderdated

1.4.2019,passedbythisCourtismadeabsolute,besidesthe

followingconditions:

a.Heshallmakehimselfavailableforthepurposeof
interrogation,ifsorequiredandregularlyattend
thetrialCourtoneachandeverydateofhearing
andifpreventedbyanyreasontodoso,seek
exemptionfromappearancebyfilingappropriate
application;

b.Heshallnottamperwiththeprosecution
evidencenorhampertheinvestigationofthe
caseinanymannerwhatsoever;

c.Heshallnotmakeanyinducement,threator

promisestoanypersonacquaintedwiththefacts

suchfactstotheCourtorthePoliceOfficer;and

d.HeshallnotleavetheterritoryofIndiawithout
thepriorpermissionoftheCourt.

e.Heshallsurrenderhispass­port.

15.Itisclarifiedthatifthepetitionermisuseshis

libertyorviolatesanyoftheconditionsimposeduponhim,the

investigatingagencyshallbefreetomovethisCourtfor

cancellationofthebail.

16.Anyobservationsmadehereinaboveshallnotbe

construedtobeareflectiononthemeritsofthecaseandshall

remainconfinedtothedisposalofthisapplicationalone.
