05/26.09.2018 The learned counsel for the petitioner submits that the
deficit court-fee has now been deposited.
2. The petitioner, who is defendant in T.M.S. No.566 of
2014, is aggrieved of order dated 14.12.2015 by which he has been
directed to pay Rs.6,000/- per month as maintenance pendente lite
to his wife.
3. In the last about 3 years the petitioner has not
prosecuted this writ petition. The trial Judge in its order
dated 14.12.2015 has recorded that marriage between the parties is
not denied and in view of the fact that the respondent is a doctor by
profession who is alleged to have earning of Rs.50,000/- must give
interim maintenance to his wife. In the present proceeding, the
petitioner has not produced any evidence which would indicate that
the order dated 14.12.2015 is patently illegal.
4. In the above facts, I am not inclined to interfere in the
matter and accordingly, the writ petition is dismissed.
