CRAN 1235 of 2018

Deepak Kumar Agarwal Ors.

vs.

State of West Bengal Ors.

Mr. Abhijit Chowdhury.

……for the petitioner.

Ms. Anusua Sinha.

…….for the State.

This is an application for quashing of the entire proceedings

being Patuli Police Station Case No.302 of 2013 dated 13th May, 2013

corresponding to ACGR Case No.3316 of 2013 under Sections

498A/406 of the Indian Penal Code read with Section ¾ of Dowry

Prohibition Act, 1961 dated 4th October, 2013 pending in the court of

Additional Chief Judicial Magistrate, Alipore, South 24 Parganas

inter alia on the grounds stated in the petition.

The defacto complainant opposite party no.2 along with the

petitioners jointly filed the application being CRAN 1235 of 2018

whereunder the parties have prayed for joint compromise and

amicable settlement by and between the parties.

Having perused the application, I do not find any reason for

continuation of the proceeding in the court of learned Additional
2

Chief Judicial Magistrate concerned since the dispute has been

amicably settled by and between the parties.

Therefore, the revisional application being CRR 966 of 2018

together with CRAN No.1235 of 2018 are disposed of.

Consequently, the quashing of the entire proceedings being

Patuli Police Station Case No.302 of 2013 dated 13th May, 2013

corresponding to ACGR Case No.3316 of 2013 under Sections

498A/406 of the Indian Penal Code read with Section 3 and 4 of

Dowry Prohibition Act, 1961 dated 4th October, 2013 pending in the

court of Additional Chief Judicial Magistrate, Alipore, South 24

Parganas is quashed.

Urgent photostate certified copy of this order, if applied for, shall

be given to the parties as expeditiously as possible.
