Husband is in revision petition against the order passed by the

learned trial Court fixing the maintenance pendente lite at the rate of Rs.10,000/-

per month.

Learned counsel for the petitioner has submitted that on the one

hand, learned trial Court has observed that wife is an income tax payee and on the

other hand, it has been observed that wife is not having any source of income.

Of course, there is some error in the order passed by the Court.

However, as per the assessment year 2015-16 wife was having income of

Rs.2,68,000/- whereas husband was having income of Rs.3,73,141/-. Husband is

liable to maintain his wife. The Court has only awarded maintenance at the rate of

Rs.10,000/- per month. The parties appear to be belonging to middle class

category and Rs.10,000/- is the minimum amount, which can be awarded to the

wife for maintenance.

In the circumstances, I do not find any good ground to interfere with

the order passed by the Court.

Hence, this revision petition is dismissed.
