ORDER

The above Anticipatory Bail Application has been filed

on the premise that the petitioner apprehends that some crime

may have been registered at Peroorkada Police Station for

offences punishable under Secs.498A 420 of the SectionIPC pursuant

to the complaint if any of the petitioner’s wife.

2. The learned Prosecutor was asked to get instructions

and today when the matter is taken up for consideration,

Sri. Amjad Ali, learned Prosecutor would submit on the basis of

instructions of the SHO, Peroorkada Police Station that, as of now

no crime has been registered as against the petitioner arraying

him as accused in that Police Station in respect of the alleged

incidents narrated in this bail application.

3. The abovesaid submission made on behalf of the

Police Agency is recorded. However, in the interest of justice it is

ordered that in case the SHO concerned gets any objective

materials to register any crime against the petitioner for non

bailable offences, then the SHO concerned will issue prior notice

under Sec.41A of the SectionCr.P.C. and then may proceed thereafter in

accordance with law.

With these observations and directions, the above Bail

Application will stand disposed of.
