Judgments of Supreme Court of India and High Courts

Dhirendra Singh vs Smt.Pushpa on 21 August, 2018

1 FA-105-2004
The High Court Of Madhya Pradesh

Jabalpur, Dated : 21-08-2018
Shri Jai Shukla, Advocate for appellant.
Miss Nirmala Raikwar, Advocate for respondent.

Heard on I.A.No.6888/2017, which is an application under Section 24 of the Hindu
Marriage Act seeking enhancement of the maintenance pendente lite.

Learned counsel for the respondent submits that vide order dated 8.7.2009, this Court
allowed the maintenance pendente lite @ Rs.1500/- per month and ligation expenses to the
respondent. The situation has now been changed because the respondent is residing separately
from her parents and due to price hike in these nine years, the amount of maintenance pendente
lite may be reasonably enhanced.

After hearing learned counsel for the parties, in our considered opinion, at present, the
amount of maintenance pendente lite @ Rs.1500/- per month is inadequate, which is hereby
enhanced to Rs.3000/- per month to be payable by the appellant to the respondent.

Accordingly, I.A.No.6888/2017 stands allowed and disposed of.
In the present case, the reconciliation has not taken place, therefore, let this appeal be
listed for reconciliation on 10.10.2018.

Parties are directed to remain personally present before this Court on 10.10.2018.
Learned counsel for the respective parties shall inform the parties for their presence
before this Court on 10.10.2018.
