3 14-01-2020 Heard learned Counsel for the petitioners and the learned
APP for the State.

The petitioner seeks bail in Mokama PS Case No.
186 of 2019 registered under Sections 377 of the IPC and
Sections 4/6/8 of Pocso Act 2012.

The petitioner is an accused for offence under
Section 377 IPC.

Counsel for the petitioner submits that that the
petitioner and the informant are on inimical terms since before.
Both are Constables in the CRPF. It is submitted that the
medical report dated 14.8.2019 does not support the allegation.

Pointing out to the allegations and the evidence
collected during course of investigation learned APP submits
that specific heinous allegations have been made against the
petitioner of subjecting the informant’s son to the offence under
Section 377 IPC. The boy has also been examined in course of
investigation and he has supported the allegations.

Considering the heinous nature of allegations this
Court is not inclined to allow petitioner’s prayer for bail.

This application is dismissed.
