     Heard learned counsel for the petitioners and learned Public

Prosecutor. Perused the material available on record.

     This anticipatory bail application has been filed by the

petitioners apprehending their arrest in connection with F.I.R.

No.29/2017, registered at Police Station Sri Vijaynagar for the

offences under Sections 406, 498A and 323 IPC.

     Admittedly, the petitioner Dipendra Singh (Husband) had

filed an application under Section 5 read read Section 12 of the

Hindu Marriage Act against the complainant claiming annulment of

the marriage on the ground of concealment of fact pertaining to

mental disorder suffered by her before the marriage. Notices of

the said application were issued on 22.09.2016. The FIR came to

be lodged on 03.02.2017 through a complaint filed in the Court in

January, 2017. The petitioners have already appeared in the

investigation. The investigating officer has not found involvement

of the petitioners No.4 to 9 in the offence. Charge-sheet is

proposed to be filed only against petitioner No.1 Dipendra Singh

(Husband), petitioner No.2 Shrawan Singh (Father-in-law) and

petitioner No.3 Smt. Kishan Kanwar (Mother-in-law) and notices

under Section 41A have also been issued to them.

     In this background and having regard to the facts and

circumstances available on record, but without expressing any

opinion on the merits of the case, I am inclined to grant pre-arrest

bail to the petitioner No.1 Dipendra Singh, petitioner No.2

Shrawan Singh and petitioner No.3 Smt. Kishan Kanwar.

     However, the application for pre-arrest bail filed on behalf of

petitioners No.4 to 9 is disposed of as having become infructuous.

     Accordingly, the bail application is allowed in part and it is

directed that in the event of arrest of petitioners    (1) Dipendra

Singh, (2) Shrawan Singh and (3) Smt. Kishan Kanwar in

connection with F.I.R. No.29/2017, registered at Police Station Sri

Vijaynagar, they shall be released on bail; provided each of them

furnishes a personal bond in the sum of Rs.50,000/- along with

two sureties of Rs.25,000/- each to the satisfaction of the

concerned       Investigating   Officer/S.H.O.   on   the    following

conditions :-

(i). that the petitioners shall make themselves available for
     interrogation by a police officer as and when required;

(ii). that the petitioners shall not directly or indirectly make any
      inducement, threat or promise to any person acquainted with
      the facts of the case so as to dissuade him from disclosing
      such facts to the court or any police officer; and

(iii). that the petitioners shall not leave India without previous
       permission of the court.
