In Re: – An application for anticipatory bail under Section 438 of
the Code of Criminal Procedure filed on 24/01/2018 in
connection with Tehatta P.S. Case No. 13 of 2018 dated
07/01/2018 under Sections 498A/304B/302/34 of the Indian
Penal Code.
And
In the matter of: Dona Pal @ Mondal Ors.
….petitioners.
Mr. A. Islam
…for the petitioners.
Mr. S. Ghosh,
Mr. B. Banerjee
…for the State.
Report is placed on record wherein it appears that the
victim stated before the doctor that she had accidentally caught
fire.
Learned counsel appearing on behalf of the State opposes
the prayer for anticipatory bail.
In view of the aforesaid fact and bearing in mind the
nature of allegations, we are inclined to grant anticipatory bail to
the petitioners.
In the event of arrest, the petitioners shall be released on
bail upon furnishing a Bond of Rs. 10,000/- each with two
sureties of like amount each to the satisfaction of the Arresting
Officer and also subject to the conditions as laid down under
Section 438(2) of the Code of Criminal Procedure, 1973 and on
further condition that they shall appear before the trial court and
pray for regular bail within fortnight from date.
The application for anticipatory bail is, thus, disposed of.
Personal appearance of the investigating officer is noted
and dispensed with.
