ORDER

This is an application for anticipatory bail under Section 438

of the Code of Criminal Procedure.

2. The petitioners are the accused in Crime No.180 of

2019 of Mira Road Police Station, Thane, Maharashtra registered for

offences punishable under Sections 498A, 406 and 504 read with

Section 34 of the Indian Penal Code. The de facto complainant is the

wife of the first petitioner. The other petitioners are the relatives of

the first petitioner. The accusation in the case in essence is that the

accused has subjected the de facto complainant to cruelty while they

were residing together.

3. Heard the learned counsel for the petitioners as also

the learned Public Prosecutor.

4. In so far as the crime is one registered in a Police

Station outside the State, the petitioner has to approach the court

concerned for anticipatory bail. However, having regard to the

accusation against the petitioners, I deem it appropriate to dispose of

the bail application directing that the petitioners shall approach the

court concerned within three weeks and obtain bail. Ordered

accordingly. It is also directed that if the petitioners are arrested in the

meanwhile, they shall be released from custody on execution of bond

for Rs.25,000/- each with two sureties each for the like sum to the

satisfaction of the arresting officer.
