appellant.

CMP No. 8339 of 2017

The learned counsel for the non-applicant

submits, that, he has instructions meted to him, by the

respondent, that he is ready and willing to pay a sum of

Rs.9,000/- per mensem as maintenance pendent-lite, to,

the applicant. However, given the fact that a sum of

Rs.7,000/-per mensem as maintenance pendent lite, is,

adjudged vis-a-vis the applicant by the learned District

Judge in the year 2011, and, also with nowat the son of the

parties at contest, pursuing his studies in 8th standard,

thereupon for meteing the expEnses of his education, and,

the elapse of time, since Rs. 7000/- per mensem, as

maintenance pendent-lite, being adjudged, by the learned

District Judge, thereupon it is deemed fit that a sum of Rs.

9,000/- per mensem be adjudged as maintenance pendent-

lite vis-a-vis the applicant. Litigation expenses

comprised, in, a sum of Rs.7000/- is also assessed vis-a-

vis the applicant. The aforesaid quantum of maintenance

pendent-lite per mensem shall occur from the date of

filing of the application. The non-applicant is directed to

deposit, the entire arrears alongwith up-to-date interest at

the rate of 6% p.a, within two weeks, in the Registry of

this Court, and, the aforesaid per mensem quantum of

maintenance pendent-lite, shall, be deposited in the first

week of every month, in, the Registry of this Court. The

application stands disposed of.

At the request of the learned counsel for the

parties, the matter is referred to Sh. N.K Sood, Sr.

Advocate, who shall embark upon a negotiated settlement

inter-se the parties at contest. The parties are directed to

appear, before, the learned Mediator in the mediation

centre of this Court, on 31.5.2018. The learned Mediator is

requested to submit his report within four weeks

thereafter.
