1. Heard learned counsel Shri S.N.Nandeshwar for
the applicants. He points out HMP No.364/2018 filed by
applicant No.1 against his wife. The said HMP is filed on
27.3.2018. The wife lodged report on 13.8.2018. He
submitted that the applicants should approach to the
Sessions Court at Asifabad and prayed that till then
anticipatory bail be granted to the applicants in their favour.
He further submitted that there is every possibility of
arresting of the applicants before approaching to the
Sessions Court at Asifabad.
2. Learned Additional Public Prosecutor Shri
S.D.Sirpurkar for the State strongly opposed the present
application.

The same is registered on 13.8.2018 with Kagaznagar Police
Station, District Adilabad, Telangana. The HMP for
restitution of conjugal rights is filed by applicant No.1 on
27.3.2018. The wife left company of applicant No.1 in the
year 2016 itself. The report is lodged after two years.
4. Offences punishable under Section 498A of the
Indian Penal Code and under Section 4 of the Dowry
Prohibition Act, 1061 are registered against both the
applicants.
5. As per the report, offence took place in the year
2016.
6. Looking to the allegations in the report,
ad interim order is granted to the applicants for a period of
15 days from today, on following terms and conditions:

ORDER

(i) In the event of arrest of the applicants, the applicants be
released on bail on they executing P.R.Bond in the sum of
Rs.15,000/- by each of them with one solvent surety by each
of them of the like amount.

(ii) The applicants shall attend Police Station Kagajnagar
(Shirpur), District Adilabad, Telangana as and when they are
called by Investigating Officer and they shall cooperate the
Investigating Officer.

(iii) Issue Notice to the non-applicant/State, returnable after
two weeks.

(iv) Needless to mention that the ad interim order granted
in favour of the applicants shall come to an end
automatically after a period of 15 days from today.
