HIGH COURT OF JUDICATURE AT ALLAHABAD

?In Chamber

Case :- CRIMINAL MISC. BAIL APPLICATION No. – 32156 of 2018

Applicant :- Gajraj

Opposite Party :- State of U.P.

Counsel for Applicant :- Abhay Raj Yadav

Counsel for Opposite Party :- G.A.

Hon’ble Sudhir Agarwal,J.

1. The present bail application has been moved by accused-applicant for enlarging him on bail in Case Crime No. 72 of 2018, under Sections 377 I.P.C. and Section 4 of Protection of Children from Sexual Offences Act, Police Station Pahadi, District Chitrakoot.

2. Learned A.G.A. has opposed the prayer for bail.

3. It is pleaded that applicant has been falsely implicated. He has not committed any crime but record shows that applicant is said to have committed offence under Section 377 I.P.C. read with Section 4 of Protection of Children from Sexual Offences Act and the victim, a minor of 11 years in his statement under Section 161 Cr.P.C. and deposition before Magistrate under Section 164 Cr.P.C. has supported the F.I.R. version and clearly said that crime has been committed under the aforesaid provisions by applicant. Looking to the entire facts and circumstances, I do not find it a fit case for grant of bail.

4. Application is, accordingly, dismissed.

Order Date :- 21.4.2020
