O R D E R

Petitioners have been arrayed as accused Nos. 2, 5 6 among the 6

accused in Crime No. 618/2019 of Nooranad Police Station which has been

registered for offences punishable under Section 498A, Section294(b), Section323, Section506

and Section34 of the IPC.

2. The prosecution case in short is that the first accused had married

the lady defacto complainant on 02/04/2018 and that 60 sovereigns of gold

ornaments were given by her parents at the time of marriage and after the

marriage, the accused persons have committed physical and mental cruelty

and harassment on her and that her gold ornaments and money have been

misappropriated etc.

3. After hearing both sides and after careful evaluation of facts and

circumstances of this case, this Court is of the considered view that the

custodial interrogation of the petitioners may not be necessary.

Accordingly, the following orders and directions are passed.

1. Petitioners shall immediately appear before the Investigation Officer

in relation to the instant crime no. 618/2019 of Nooranad Police Station for

interrogation purposes without any further delay at any rate at 10 a.m on any

day on or before 15/06/2019.

2. Petitioners will fully co-operate with the Investigation Officer in the

above interrogation process. After the interrogation process is over, if the

Investigation Officer arrests the petitioners in relation to the above said crime,

they shall be released on bail on them, separately executing a bond for

Rs.40,000/- (Rupees Fourty Thousand only) each and on them separately

furnishing 2 solvent sureties each to the satisfaction of the Investigating

Officer concerned. However, the grant of bail may be subject to the following

conditions.

(1) The petitioners shall not involve in any criminal offences of similar nature.

(2) The petitioners shall fully co-operate with the investigation.
(3) The petitioners shall report before the Investigating Officer as and
when required in that connection.

(4) The petitioners shall not influence witness or shall not tamper or
attempt to tamper evidence in any manner, whatsoever.
(5) If there is any violation of the abovesaid conditions by the petitioner
then the jurisdictional court concerned stand hereby empowered, to consider
the plea for cancellation of bail at the appropriate time.

With these observations and directions, the above Bail Application

will stand disposed of.
