Heard on I.A.No.115/2019, which is first application for suspension of
jail sentence and grant of bail filed on behalf of applicant.

The applicant has been convicted for offence under Section 354 IPC
and sentenced to undergo RI for 1 year with fine of Rs.500/- with default

Learned Counsel for the applicant submits that the applicant is in jail
and a labourer. He was on bail during trial and, therefore, he be released on

After having perused the impugned judgment and on consideration of
the facts and circumstances of the case, without expressing any opinion on the
merits of the case, I.A. No.115/2019 is allowed. The substantive jail sentence
of the applicant is suspended subject to his depositing the fine amount and
furnishing a personal bond in the sum of Rs.30,000/- (Rupees Thirty
Thousand only) with a solvent surety in the like amount to the satisfaction of
the trial Court for his appearance before the Registry of this Court on
01.03.2019 and thereafter on all subsequent dates as may be fixed by the
Registry in this behalf.
